1. About these terms
These terms and conditions govern your use of BookedSolid's services and form a binding agreement between you and BookedSolid. By using our services, you agree to these terms in full. If you disagree with any part of these terms, you must not use our services.
BookedSolid is a revenue growth system that eliminates administrative work for service businesses. We capture leads, automate bookings, and manage reviews so you can focus on delivering your services to customers.
Our contact detail is contact@gobookedsolid.com
2. Our services
BookedSolid provides comprehensive business automation services designed to eliminate administrative burden and increase revenue for service businesses. Our core services include lead capture and distribution systems that ensure no potential customer enquiry is lost, online booking automation that allows customers to schedule appointments directly into your calendar, automated follow-up communications that maintain customer engagement, review request and management systems that build your online reputation, and comprehensive reporting dashboards that show your business performance.
We handle the complete setup and ongoing management of these systems, allowing you to focus entirely on service delivery while we manage the administrative processes that drive your business growth. Our services are designed to work seamlessly together as an integrated solution rather than separate tools.
3. Service availability and performance
We strive to maintain high service availability and will use reasonable efforts to ensure our systems operate efficiently and reliably. However, we cannot guarantee uninterrupted service due to factors including internet connectivity, third-party service dependencies, scheduled maintenance, and unforeseen technical issues.
Planned maintenance will be communicated in advance where possible, typically during low-usage periods to minimise disruption to your business. In the event of service interruptions, we will work diligently to restore full functionality as quickly as possible and will communicate updates on resolution progress.
While we implement robust systems and monitoring, service interruptions may occasionally occur. We are not liable for any business losses that may result from temporary service unavailability, though we will work to minimise such occurrences through proactive system management and rapid issue resolution.
4. Your responsibilities
As a client of BookedSolid, you have certain responsibilities to ensure our services work effectively for your business. You must provide accurate and complete business information including contact details, service offerings, pricing, and availability schedules. Any changes to your business information must be communicated promptly to ensure our systems reflect current details.
You are responsible for maintaining professional standards in all customer interactions facilitated through our systems. This includes honouring bookings made through our platforms, responding appropriately to customer enquiries, delivering services as advertised, and maintaining the quality standards that build positive customer relationships.
You must ensure that any content provided to us, including service descriptions, pricing information, and promotional materials, is accurate, legal, and does not infringe on third-party rights. You are also responsible for complying with all applicable laws and regulations related to your business operations, including consumer protection laws, privacy requirements, and industry-specific regulations.
5. Payment terms
Service fees are confirmed at signup and charged monthly in advance on the anniversary of your service commencement date each month. Payment is processed automatically through your nominated payment method, and you are responsible for ensuring sufficient funds are available and that payment details remain current.
Our fees cover the complete service package including system setup, ongoing management, customer support, and all technical infrastructure required to deliver results. Additional services outside our standard offering may incur separate charges, which will be clearly communicated and agreed upon before any work commences.
Late payment may result in service suspension after appropriate notice. If payment remains outstanding for more than thirty days, we reserve the right to terminate services and pursue recovery of outstanding amounts. Any costs associated with debt recovery, including legal fees, may be charged to your account.
6. 30-day satisfaction guarantee
We offer a 30-day satisfaction guarantee for all new clients. If you are not satisfied with our service within 30 days of commencement, we will provide a full refund of all fees paid during that period. To request a refund under this guarantee, simply contact us at contact@gobookedsolid.com within 30 days of your service start date.
This guarantee reflects our confidence in the value our system delivers to service businesses. Refund requests will be processed promptly, typically within 5-7 business days of approval.
7. Intellectual property
BookedSolid retains all intellectual property rights in our systems, processes, methodologies, and proprietary technologies used to deliver our services. This includes software, algorithms, workflows, templates, and any improvements or modifications developed during the course of providing services to you.
You retain ownership of your business information, customer data, and content that you provide to us. However, you grant us a licence to use this information as necessary to deliver our services effectively. This licence includes the right to process, store, and transmit your information through our systems and approved third-party services.
Any custom work or modifications developed specifically for your business remain our intellectual property unless explicitly agreed otherwise in writing. However, you receive a perpetual licence to use such customisations for your business operations, even after service termination.
8. Data protection and privacy
We take data protection seriously and handle all information in accordance with Australian privacy laws and our comprehensive privacy policy. Your business information and customer data are processed solely for the purpose of delivering our services and improving your business outcomes.
We implement industry-standard security measures to protect all data in our systems, including encryption, access controls, and regular security monitoring. However, no system can be completely secure, and you acknowledge that some risk is inherent in any digital service.
You are responsible for ensuring that any customer data you provide to us has been collected legally and that customers have provided appropriate consent for the processing activities we perform on your behalf. This includes consent for communications, review requests, and data storage necessary for service delivery.
9. Limitation of liability
BookedSolid's liability to you is limited to the greatest extent permitted by law. Our total liability for any claims arising from our services will not exceed the amount of fees paid by you in the twelve months preceding the claim. BookedSolid assumes all corporate liability and responsibility for service delivery under these terms.
We are not liable for any indirect, consequential, or special damages including lost profits, lost business opportunities, or lost data, regardless of whether such damages were foreseeable. This limitation applies regardless of the legal theory under which liability is claimed.
We make no warranties about the specific business outcomes you will achieve through our services, though we work diligently to deliver the results our systems are designed to produce. Business success depends on many factors beyond our control, including market conditions, service quality, and business management decisions.
10. Indemnification
You agree to indemnify and hold BookedSolid harmless from any claims, damages, or expenses arising from your use of our services, your business operations, or any breach of these terms. This includes claims related to the content you provide, your interactions with customers, or any violations of applicable laws.
This indemnification extends to legal fees and costs incurred in defending against such claims. However, this does not apply to claims arising solely from our negligence or misconduct in providing services.
11. Service termination
Either party may terminate services with thirty days written notice. Upon termination, you remain responsible for any outstanding fees incurred before the termination date, and we will provide reasonable assistance in transitioning your systems and data.
We may terminate services immediately if you breach these terms and fail to remedy the breach within seven days of written notice. Immediate termination may also occur if your account becomes significantly overdue, if you engage in illegal activities, or if continued service provision becomes impractical.
Upon termination, we will provide you with access to your data for a reasonable period to facilitate transition to alternative services. However, we are not obligated to maintain your data indefinitely and may delete it after a reasonable transition period.
12. Service modifications
We may modify our services from time to time to improve functionality, add new features, or adapt to changing technology and market conditions. Significant changes that materially affect service delivery will be communicated in advance where possible.
We may also update these terms and conditions periodically to reflect service changes, legal requirements, or business developments. Material changes will be communicated by email or through your service dashboard, and continued use of our services constitutes acceptance of updated terms.
Price changes will be communicated at least thirty days in advance, giving you the opportunity to evaluate whether to continue with services under the new pricing structure.
13. Force majeure
Neither party will be liable for delays or failures in performance resulting from circumstances beyond their reasonable control. This includes natural disasters, government actions, internet outages, third-party service failures, or other events that prevent normal service delivery.
During force majeure events, we will make reasonable efforts to maintain service continuity and will communicate with affected clients about expected resolution timeframes where possible.
14. Dispute resolution
Any disputes arising from these terms or our service relationship should first be addressed through direct communication between the parties. We are committed to resolving issues promptly and fairly through good faith discussion.
If direct resolution is not possible, disputes may be escalated to mediation through a mutually agreed mediator. As a last resort, disputes will be resolved through the courts of Victoria, Australia, and Australian law will govern the interpretation and enforcement of these terms.
15. General provisions
These terms constitute the entire agreement between the parties regarding BookedSolid's services and supersede any previous agreements or understandings. Any modifications must be made in writing and signed by both parties.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving the original intent.
Our failure to enforce any provision of these terms does not constitute a waiver of our right to enforce that provision in the future. All rights and remedies are cumulative and may be exercised concurrently or separately.
16. Contact information
For any questions about these terms and conditions or our services, please contact us at contact@gobookedsolid.com. We are committed to maintaining clear communication and addressing any concerns you may have about our service relationship.
All contracts are with BookedSolid.
These terms and conditions are governed by Australian law.
